T-Mobile Phone Contract Question? (Simple)?

Hey, I have a simple question here.

I just got a new T-Mobile contract from my Dad, and got a new phone with it. Thing is, I prefer my Old Phone. I want to sell the new phone.

Do i HAVE to have the new phone to use the Contract? Like, they won't ask for the Phone back or anything like that?
