T-mobile cell phone users.?!?

My ex already had a cell phone contract with t-mobile, he had a BB & added me on his plan & got me a BB too. Now we aren't talking anymore & i love the phone i don't want to have to get rid of it. But now i can't use it because i suppose he won't be paying for it. Or want to keep paying for it if i'm using it, & plus we aren't talking. The account is suspended now because it needs to be paid. My question is what are my options to do with it.? Is there anyway i can get off his plan & keep the phone & ever get it in my name.?
