Swindled into contract by Rogers Wireless?

Friend was under a Rogers family plan with a black berry. (it was her sisters husband who was an employee) long story short my friends sister and husband split up. All the family plans he switched off onto their own plans.
First bill arrived and says that my friend is under a 36 month contract. The phone itself is a handme down. She always just gave the money to her sister to pay the bill for her…
Shes never signed or verbally agreed to any contract. And yet Rogers is saying she can’t cancel it. Can they do this? And is there a way to get out without paying the $500 cancelation fee?
 
I have always dealt with ATT and Verizon on this sort of thing. It sounds like they did a transfer of service which would do take it out of one person name put it in another. She should also look into a buyers remorse type change back. A 36 month contact sounds a little long. I would double check that on their website. I would also check to see if it is a paper error and go into a company owned store location. CALMLY ask the representative if they could double check this because you don't understand this paperwork and if they could explain it to you. That person should then check over your account and see what the scoop is. Look for someone that has a clue about what they are talking about. If a store isn't available in your area call them if you get a representative that is clueless hang up and call again.
 
Dispute the validity of the contract and ask to see a signature.

Contact the Consumer Affairs Bureau where you live and make a report if Roger's doesn't do anything. You'd be surprised what a little heat can do.
