Jodward is an aspiring singer. After seeing his potential to “make it big,” Louise Walshe, a professional manager of many entertainment industry stars, offers to represent him. Realizing that a person with Louise’s connections could open many doors for him in the industry, Jodward agrees to the representation. Under the agreement signed by the parties, Walshe would be paid a commission of 25% on all income generated by Jodward as a performer from all sources. The agreement provided that Walshe would be paid this commission for life notwithstanding the termination of representation. In other words, while Jodward could terminate the agreement after 5 years, he would still be obligated to pay Louise the commission as long as the latter lived. A few years after the contract was signed, Jodward signed up with a major recording label and became a major star. Differences cropped up between him and Louise. After the 5 year period of the contract expired, Jodward hired a different manager. He comes to you for advice on the enforceability of the provision requiring him to pay commissions to Louise for life. How would a court treat the provision?

Can anyone provide a case from English or Irish contract law that dealt with a similar issue.
