Sprint phones question...?

I have sprint for a cell phone provider. the phone I have now is falling apart and I hate it anyway. so my question is, can I upgrade my phone even if it isn't my year upgrade yet? will this be breaking my contract? does it cost me extra besides paying for the new phone? are there any service charges?
