no, the constitution says that all people made by the creator (which is a very ambiguous term by the way) are given human rights whether or not they believe in him. Creator can be taken to mean nature in this context, and it probably does because the authors were deists.
 
"We hold these truths to be self-evident, that all men are created equal, THAT THEY ARE ENDOWED BY THEIR CREATOR WITH CERTAIN UNALIENABLE RIGHTS, that among these are Life, Liberty and the pursuit of Happiness."

So, can it be said, according to the Declaration of Independence, that a person that doesn't believe in a Creator, is saying that they have no guarantee of personal rights?

What gives a person the guarantee of personal rights, if not the Creator? And who will stop someone from taking away your rights, if you don't agree that the Creator gave them?

I guess the only answer other than God would be that the government gifts us with allowable courtesies. They did this with the stroke of a pen. So, I guess those rights are only valid until someone else decides to take those rights away with a stroke of a different pen.
