Assuming that your son-in-law did not start the fight, then yes, for assault. You could also report him to the police, of course.
 
so my son in law was sucker punched by a manager at a restaurant, can we sue or ask for some money or what can we do
the manager hit him first then he hit him back we have witnesses the police came and let my son in law go and did nothing to the manager

What are you suing for? Did he has medical bills because of this hit? Has he been unable to work because of this hit? Of course you can sue but if this hit from the manager didn't cause your son in law to lose money why would you sue. You should press charges on the manager but you shouldn't sue. People are to sue happy. Are you just looking for a fast buck?
