Smartphone service plan options?

I am at my 2 year renewal and would like to get an HTC Ozone; however, I do not want to pay $25 a month for the email package that Verizon makes you get if you upgrade online (I basically just want it for the wi-fi, storage, and Windows style apps). If I independently buy an Ozone, or any smartphone for that matter, off eBay and activate it online will Verizon automatically begin charging me for for the email access or will I stay on my current plan?
 
In case anyone was interested in the answer to this question I talked to Verizon today. As of right now, all Blackberry's and any other smartphone produced after 16 NOV 2008 require some sort of data plan which will run either $30 or $50. Any smartphone that you independently buy that was produced before that date does not require a data plan.
 
There is a way around it if you talk to the right person. I bought my Palm Centro at Best Buy and was not aware of the Data plan that u have to get, so i was guna return the phone but the girl said she could take it off and just leave it as a pay as u go plan. Sure enough this is what she did and I have had my phone for a good 5 months n no charges...
 
That is a Palm Centro which came out a very long time before the new data plan rules were in place so you can do a PAYG plan with it. New smartphones released after Nov 14,2008 and ALL Blackberries require data plans for the length of the contract. PERIOD.
 
Yea it came out a while back, but Verizon was saying that I needed to have a plan with it and would not take it off. So Best Buy said i could cause they are retail sellers and were able to take it off. So im not sure...
