Should my dry cleaner be responsible for the full cost of replacing my business suit???

They lost the pants from my 2 pc suit. Original purch price of suit = $299. Suit was 3 1/2 years old when lost.

I had to provide the "original" receipt of the suit - which Men's Wearhouse could not provide from their register. Instead they gave a hand-written copy and advised that they are willing to validate that info over the phone to the cleaner's agent.

The insurance agent is offering up to 30% of the orig cost ($89.70) citing depreciation,despite the fact that the owner of the cleaners described the suit was hardly worn, and in mint shape as that is the condition of the jacket portion.

That offer only stands as long as he gets to keep the jacket portion of the suit, otherwise he will only offer $75 in lieu of the pants.

The business owner of the dry cleaners have pledged to equal the amount offered by their insurance company and credit my account $60 for future services.

Bottom line-I have to pay $120 to replace my suit. Is that fair or do I have a legit complaint?
