Shooting of burglary suspect unjustified, family says

DENVER - Relatives of the teenager killed during an attempted burglary in Denver early Monday do not believe the shooting was justified.

They are not making any excuses for 17-year-old Marcus Duran, but question the actions of the homeowner.

"So he was doing wrong, why does he deserve to get shot in the head two, three times?" said Duran's godmother, Phyllis Chavez

The homeowner shot and killed Duran during an attempted burglary early Monday morning, Denver Police said.

Police spokesman Sonny Jackson said officers responded to a 911 call from a home in the 3100 block of Gaylord St. at 2:20 a.m. when they heard gunshots at a house across the street.

"Officers went to 3150 Gaylord Street and found one male who appeared to be suffering from a gun shot wound," Jackson said. "He was pronounced dead at the scene."

Police found Duran, lying on the porch. The coroner said he died from multiple gunshot wounds to the head.

Another suspect was taken into custody for attempted burglary while a third remained at-large.

The homeowner was taken into custody and later released. The Denver District Attorney's Office will determine if the shooting was justified under Colorado's "Make My Day" law, which allows people to use deadly force to protect themselves from intruders in their own homes.

"They are using the Make My Day Law, and it's not Make My Day if he was on the porch," said Duran's grandmother, Paula Gonzales.

Damn..Denver is more hardcore than New York???

getting shot MULTIPLE TIMES IN THE HEAD seems more of an execution.

If you are going to shoot a threat, you shoot until that threat is dead.

You don't shoot to wound.

Any class you take will teach you that. If you have to shoot the person 10 times and reload then that's what you do.

double taps or mozambique drill are what any good shooter practices.
 
When you are in your own home, with someone breaking in, fearing for your life, do you really think you are going to only squeeze out one bullet?

Dumbass got what he deserved. If only all burglary cases could be handled this efficiently.
 
Given the little info I have I'd guess the shooting was justified. Guy was trying to break into the house. So shooting him the first time was clearly justifiable. Assuming he shot 3 times in rapid succession, so were the other shots as he didn't have time to reassess the situation and determine that the burglar was no longer a threat between shots. The fact he was a good enough aim to hit him in the head 3 times doesn't change that. The only way the 2nd or 3rd shot wouldn't be justifiable is if he shot him, saw him fall to the ground and realized he was no longer a threat... but decided to shoot him again anyway.

That being said:



Sure, shoot to kill if you can (and if you don't have a kill shot, shoot to wound.. I mean, wounding him is better than not firing at all). But unless you just worded your post poorly I disagree. You don't keep shooting until the target is dead. You keep shooting until your target is no longer a threat.

Like I said, you may have worded your post poorly. But following your advice people would go from self-defense/justifiable homicide territory to murder territory in hurry.
 
ya tough guy you should go to iraq or something and see what its like to shoot people. itll be just like bad company, only more recoil and better graphics
 
Yea, the homeowner should have aimed for the arms and legs... it works so well in the movies.
