I am suppose to give 3 days prior notice of subpoena being served. And even though I typed up the subpoena notices correctly, it was served wrong. A third party sent it certified mail, but with my signature on the actual notice. That was a huge mistake as rule 45 says a third party over the age of 18 is suppose to do everything. How do I fix this?
I should of have a process server serve for me. I am poor though and can't afford that. My motion to proceed informa pauperis was actually signed off on by the judge and court clerk both.
This is a federal civil complaint. ADA, US constitution, Rehab Act, etc.
MacJedi, "subpoena" itself was not served yet only a "notice" of subpoena. The actual subpoena is a subpoena duces tecum.
