The context of the Constitution is exactly that the federal government cannot/does not/has no ability to/is not even mentioned in the Constitution, to force a business to serve or to not serve anyone. The Constitution is about restrictions on the Federal govt., not what people are allowed to do.
 
Yes, the Civil Rights Act was enacted well before there were separate drinking fountains for whites and blacks. What in the fuck are you talking about?

So how are you not infringing on the business owners freedom when you tell him who he must do business with?
 
Everyone discriminates every single fucking day. You choose who your friends who, who you associate with, who you date, etc. Those choices are conscious, discriminatory decisions you make. Some reasons may be more rational than others. Some reasons may be more moral than others. But discrimination is part and parcel of human nature and of the right of freedom of association.
 
No one is harmed by making it illegal to refuse someone business based on race/gender/whatever. People are harmed when they are refused access to things others enjoy based on those things. It's so simple.

Why is it such a big deal for you to be able to discriminate based on a persons race?
 
That's what they use, sure. But how is the average small town shop, an interstate business ?
 
As retarded as it may be, people have had no problem doing this in the past.



Not shopping there or shopping somewhere else is not always a viable alternative. If I have to have the supplies I need shipped to me I am at a cost/time disadvantage to my white (or whatever race) competitors and I won't be able to compete with them for long.


How about this; I come down with a relatively rare form of cancer, and my best chance of survival is with a privately owned, specialty clinic. The owner is a racist and refuses to see black patients. He can afford to do so because the vast majority of his business comes from white patients. Do you believe it's okay that I be refused the best health care available due to the color of my skin?
