refile for court for same charge?

i recently had court and they dropped all charges because the witness (the guy who filed the charges) didnt show up, now i looked into the case search and it says that same guy filed for another one for this month coming up for the same exact charge that has been dropped.... can he do this?!?!! its been dropped already!!!.
 
Yes, they can do it. You can't be tried twice for the same crime, but if the case was dropped before trial, they can refile the charges, depending on the judge's ruling at the time the case was dropped.

They probably found the witness or more evidence. (Witnesses don't file charges, they file complaints. The prosecutor files charges.)
