Rear collision accident - Adelaide?

Hi All,

I am seeking some advice from you as i have recently been in a car accident. I has the driver of a registered car, driving on a public road. I was behind a van and we were approaching the intersection. I started slowing down and all of a sudden the van in front brake suddenly and pulls towards the left. For a split second I thought the driver was changing lanes before i realised they were actually stopping. I beaked as hard as i can but it was too late resulting in left front of my vehicle hitting right rear of the van's bumper. The van bumper suffered some small dents but my car had crushed headlights cover, dented hood and dented front bumper.

I got a call from the other driver saying i will have to pay their insurance company for the damage. I only have the compulsory third party insurance. I would like to know whether the driver bumping from behind is always the one at fault for any rear collision accidents? Is this a case that i can dispute and if so what should I do?
