I'm starting a small t-shirt company and just found out through internet search that someone already has a clothes company with that name. Is it illegal to use the same name? Because it was my understanding that you couldn't trademark words. Also I did a trademark search on the government website and they said that the word (except in all capitol letters) was already trademarked, however it said that the person who trademarked it was dead and the trademark abandoned.
