Principal took away IPOD an not givint back. Is this against the law?

My younger brother had his ipod taken away by his school. The principal refuses to give it back. Is this against the law? What should we do? What are our legal options? Its a private school. He is afraid they might expel him if he pushes to hard to get it back.
 
If you can get your parents to demand it back then the principal will probably listen to them as principals tend to be big suck-ups.
