Possible to take legal action against tmobile for selling me an unsuitable contract...

...phone (non-refundable)? This might sound stupid to some people who know smartphones inside/out etc but i purchased an unsuitable contract phone from t-mobile (uk) and want to get rid of it/cancel teh contract.

2 days ago without much knowledge about phones i walked into my local branch of t-mobile and asked to look at the cheapest blackberry possible (that allows web browsing.)

When i selected a phone to buy i made sure i asked the lady at the counter "does it access all websites ok?" she replied "Yes it does sure".

But the blackberry i bought accesses sites by being redirected to mini sized versions for the mobile phono. Ok for someone to spend 10 seconds visiting but lacks most of the features of the full version of the sites. Most of the sites i want to visit dont work or have issues with formats and java.

I wanted to give the phone back after 2 days because its pretty much useless as a internet browser for me. Ive bought a htc desire from another place and thats fine.

Today when i tried to hand the blackberry back they said the only option i have is to select another phone and continue paying £25 a month (for 2 years or do nothing and till pay £25 a month for 2 years.

Do you think im entitled to some help because they misinformed me at the time of purchase meaning the product did not fulfil the requirements i had? Do you think i can take legal action against t-mobile?
