I've answered this many times (not on here). We came to the conclusion it's out of habit and not to "torture" people. It's illegal to not follow the codes.

Sometimes an execution can get called off at the last minute. If it is called of and the inmate gets a desease from the needle, or claims to have gotten one- he would be able to sue for millions.

At point of manufacture all needles are guaranteed to be sterile until the seal is broken. Nobody administering the lethal injection would want to handle a non-sterile needle in case of accidental needle stick injury. So there you have why.

Because all hypodermic needles are already sterilized as needles are ordered through a hypdermic company which supplies to not just lethal injections.
