...still have a problem? 9)Ann promises to pay her cousin Bert, who is dangerously obese, $10,000 if Bert loses 100 pounds within the next two years. Bert agrees, per¬forms his part of the bar¬gain, and asks for the money. Ann refuses to pay, saying that she forgot about the deal, but that even if she did make such a pledge, there was no valid consideration for it. Bert files a suit against Ann. In whose favor is the court likely to rule, and why?

3)Ann operates Ann’s Fruits & Vegetables, a small market stocked entirely with produce grown on her adjacent farm. Under what clause of the Constitution can the federal government regulate Ann’s activities? What is Ann’s best argument against federal regulation of her farm and business?

11)Best Products, Inc., hires Cole to develop and implement an e-commerce strategy for marketing Best’s products. Cole signs a contract that in¬cludes a clause prohibiting him from competing with Best during and af¬ter the employment. Before the strategy is implemented, Cole resigns from Best’s employ and opens a business to compete with Best. In Best’s suit against Cole, to determine whether Cole may compete with Best, what is the most important factor the court should consider?

Answer: The problem I have with this there were no written contracts stated. Therefore in what evidence do you have to back a claim? I can say Bank One of America agreed to pay me One Million Dollars, and failed to do so. But what do I can to prove it? Verbal contracts are not as strong as written. Court will likely laugh, but maybe give some “pain and suffering” to the Bert in favor that he made an effort, which I don’t know what amount. But I would be surprised.

Answer: This one I don’t know. But I bet it probably has to do with health and safety issue.

11) Best Products, Inc. hires Cole to develop and implement an e-commerce strategy for marketing best’s products. Cole signs a contract that includes a clause prohibiting him from competing with Best during and after the employment. Before the strategy is implemented, Cole resigns from Best’s employ and opens a business to compete with Best. In Best’s suit against Cole, to determine whether Cole may compete with Best, what is the most important factor the court should consider?

Answer: The court in my opinion would need to review this contract first off. If Cole signed a one year no compete clause than that means through the whole duration of his contract. But if the contract states a void at anytime, he has a right to leave. Now if it don’t and he breaks out, my guess he can be sued, however in most causes a no compete are likely not to be strong anyways. I might be incorrect on this, but I am taking a wild guess.

9.) Ann, verbal contracts won't hold up for that kind of money, I belive.

3.) I don't know what clause exactly, but her best argument is probably that it's private property.

11.) What the time limit of the contract, if any, was.
