I was hit head on and the other driver was ticketed for failure to reduce speed to prevent an accident. I put the claim through my insurance company and they are going to go after his since he was at fault.
My car was totaled, and I am going to end up owing about $1500 more on it than what the insurance company is going to give me. Am I able to seek out the other $1500 from him for the remaining balance? Is this done in small claims court?
Also, my insurance company said that I could put a separate claim into his company for pain & suffering. Is there a usual amount? I was taken by ambulance from the scene and sustained extensive bruising on both knees and across my chest from the seatbelt.
