My ex is receiving a work comp settlement and we were in agreement and have already signed papers that I get 20% for child support. We signed the court papers a month ago. His attorney has had the check for a month now and has not disbursed any checks yet. My atty received a fax from him stating what the amount of the settlement was, and it was less than what my ex had told me; therefore, falsifying agreement documents. My atty requested that he send a copy of the original insurance agreement documents to verify the settlement amount. My ex's atty keeps ignoring the request and will not return any phone calls. He has attempted to get the originals from him for 3 weeks now. My ex and I are on very good terms and are both frustrated as neither one of us have received any money yet. We are trying to work on this together, but his atty keeps ignoring everyone. What next?
Just found out that my atty has ordered my ex's atty to court tomorrow and he has to bring the documents with him. Can I counter sue? What will happen to him for trying to falsify documents and for holding the checks possibly to try and collect interest on the money.
