Need help w/work comp issue please?
Ok so I got injured at work. I weigh abt 110-112lbs and was lifting bags of soil. What I mean by this is it's a soil testing company so the farmers, agronomists put their samples into smaller bags which in turn go into about 2/12-3 foot tall bags.
I've never had problems lifting heavy weigh before even for my small frame. However I went to lift a bag weighing approx. 50-60lbs. I felt a pull in my back and lost my breath. I thought it wld go away but after two hours I reported it. They told me to keep working and take as many brakes as needed.
Well when it was almost lunch time I said I can't take this pain, so I had to go to the Temp agency and do a drug test, alcohol test, etc. All came back clean as a whistle. They were going to wait for their HR to come 1 1/2hrs away then set an appt to TRY and get me seen that day. I cldn't wait so had a friend take me to the ER. The ER thought I sprained my back, wanted me off work for a few days then had me on major restrictions when I went back but I havn't went back at my family Dr.s request, whom I've seen twice. At the second visit after he realized PT wasn't helping, he requested and MRI. Work Comp refused then scheduled an appt with their Dr.
Just like the attorney said they would do. Well this Dr. found something wrong just in the x-ray. He said it looks like I have a fracture in my back and wants an MRI. Insurance called me after and said she would schedule the MRI right away but the insurance behind my back told the Dr. they want me back to work. So he put me on so many restrictions just to try and suffice the ins. HR called me and told me to come back to work tomorrow. They said they had office work for me to do but the Dr. said not for me to even twist my body which means not even twisting in a chair to answer the phone.
So here is my question. When HR called he said I have to fill out some type of modified restriction form and I can refuse to sign it but if refuse to sign it then I would lose all my benefits but I'm just positive they are going to have this letter so legalized I won't understand it and get screwed. I want to call in sick and let my attorney read this modified letter before I sign anything. Is this wrong an can they fire me for this.
Plus another thing. my family Dr. has me on high doses of pain meds and muscle relaxers that I shouldn't even b driving, but I don't want them to try and say I'm not following Dr.s orders when one minute my Dr. tried for the MRI and was denied but they approved their Dr. and made him put me back to work with a fractured back. Yes, I'm getting my papers filled out and faxed to attorney yet tonight but I don't know what to do about tomorrow cause the minute I walk in the door they will want me to sign the paper, if I say I want my attorney to look over it first, they can say then ur refusing to sign it. They can lie and say I never mentioned having my attorney look at it.
Should I call in and tell them the pain is still to unbearable and get to my family Dr on Friday? Anyone been through this cause I never have. Just tired of the pain and the run around. Please someone help. I'm only 33 and don't want my back messed up for the rest of my life for going back to work while still injured with atleast a fractured back but could be worse.
