Naming my Business. Trademark issues. Help!?

I am starting a business in Florida and selected a name. Unfortunatley someone in California has the same name for the same type of business.

Can I use the same name but spell it differently? What are my options? I know the obvious answer is to change the name completely, but the name selected is absolutley PERFECT for the marketing, advertising and items we want to carry.

Example: Dame Boutique (in California)
Can I use: Dayme Boutique (in Florida)

Unfortunate, indeed.

The California company can (and probably will) come after you for trademark infringement, and they will probably win.

They were there first.

Pick a different name.
