My wife is an illegal immigrant who entered without inspection. What do I do?

I met my wife in 2005 and very soon after she became pregnant. It was not until a few months after I found out she was pregnant and she was living with me that I found out she had some immigration issues, although I didn't know how bad they were. We got married in 2009, our daughter is now 5, and our application for a change of her status was recently rejected by USCIS. Apparently as I am now finding out, she entered the country with her parents when she was only 18 months old, without inspection. This is about the biggest no no there is in the immigration world. There are a few things we tried (her parents got their green cards through Amnesty) but is seems that since no one petitioned for her before 2001, she has no legal ground to stand on.

My question is this: Since she has no legal option but to either go willingly or unwillingly back to Mexico forever, should we just wait for her to get deported? Or should we hide and worry and wait for a law to change? My daughter and myself are American and we are not going to live in Mexico.

the law wont change, no one cares about foreigners who broke our laws. She is better off leaving and then you can apply for her to come back after the ban

Find a good Alia lawyer experienced in handling cases like your wife's. She may have to return to Mexico to wait up to a year for an immigrant visa if her Waiver of Inadmissibility is accepted. Some YA members have claimed that it is even possible for people like your wife to remain in the US and get a green card if she has no other issues besides illegal entry as a child.
