...pay for 75 pounds of apples? Hello. My name is Jessica and this is my first question with yahoo answers, so I hope I am doing it correctly.
I am having a problem finding information about this online. Me and my son were at Kroger this morning and I asked him to go get me 5 apples. He does this all the time for me, he is 6 and I was about 15 feet away. He had 2 and when he picked up the third one, the entire pile of apples fell on him and knocked him down. This happened at 8:30 this morning and already he is starting to bruise all over as if he was in a car wreck. The manager would not let me leave until I either paid for the apples (which he said was roughly 75 pounds worth) or signed a release and have it notarized at the in store bank saying I would pay for their loss. At 1.99 per pound he wanted $149.25 on the spot. Only a handful of apples were crushed and they were crushed on my son!! I told him that I should be the one to sue him and so he actually called the police who told him that it was a civil matter. I did give him my name at first because he acted like he was worried for my son, but right after I gave him my name and number, he changed his tune. Legally where do I stand? I don't feel I should have to pay for the apples because it is not like he grabbed them from the bottom of the stack. They were on top. I don't know if the barrier gave way with so many apples on there or what. I am just upset at the thought of losing $149 that I do not have, and not only that, my son is literally bruising from head to toe. What should I do legally?
