you don't. you realize he is a loser and look for a guy who isn't in jail, and can like actually help you raise your child. and none of that "it was trumped up charges" or "he is totally innocent" crud. odds are he is guilty, or should have been hanging out with people who wouldn't have caused him to go to jail.
