My little brother was hit by car while riding his bike?

He was on his way school and the lady said she didn't see him,my brother was hurt the police took the report and said they were both at fault because he was riding the wrong way on bike lane,because his school on left side .The lady wasn't looking.So can we sue her?
 
im not really sure.... if your brother WAS riding the wrong way in the bike lane, and they are both at fault, then there is a chance that if he was riding the right way in the bike lane none of this would have happened at all...
