my job has said that i voluntarily quit but i didn't they basically have no proof...

...will this hold up in court? I got no hours for just about two months,but I still continued to call in and check my schedule. The GM does this to alot of people who work there. I then called after about a month of waiting to see if I would get any of my hours back. I work part-time and i'm a student. He had told me that they already hired new people and there isn't any hours left for me. If there are any hours he would then see if maybe he could give them to me. and when I spoke to him, he had no intention of firing me or any of the sort.

So then after about two more weeks I didn't get any hours and I needed to get hours because I had bills to pay and for my school tuition. I then filed for unemployment and the following thursday I called in to check to see if I had any hours and they had told me that I was no longer on the schedule. At this point I was confused. And when I tried to call the GM he was at either at a meeting, busy, or they put me on hold for over ten minutes. When I did get ahold of him he did not tell me why I was no longer on the schedule, instead he had told me that he was busy working the saturday night. He then told me to call back monday in the afternoon and which I did but they put me on hold for over ten minutes and was not able to speak with him.

And then the next day unemployment calls me and tells me that I had voluntarily quit for personal reasons as stated by my previous employer. I did not quit I tried to stay on as long as I could. I wanted hours back thats why I kept calling every week when schedules were put out to see if I had any hours that week. But I find it funny how I was off the schedule a week after I filed for unemployment.

When unemployment had asked for them to rebuttal my statement of saying I did not quit they had no responded. So the decision was to continue my unemployment benefits, but my previous employer had appealed that my claims should be denied because i had voluntarily quit for personal reasons but I didn't quit.

What do you guys think of this? Can they do this? Do I even have a chance against this? It's little fish against big fish.
 
This might not be a solid answer, but this sounds an awful like Target. LOL I used to work there and they pulled the same BS with me but I was full-time all of a sudden I became BARELY part time with 5 hrs a week. Then they fired me for "poor performance". The entire thing was bullshit.

If GM did not respond, it is an admission. Your former employer has no say in the matter, and unemployment should not even pursue it for them.

You should be fine. GM can try to do this, but typically will not get away with it. You have IMHO experienced what I refer to as "the dept of no" That is where a company has the first call...or 3 calls...or 5 calls in a system to tell you no, no matter what. Then through persistence, they typically relent. Insurance companies are famous for this...and a lot of employers try to deny once in hopes that you will give up. It is a harsh game and is wrong, but they do it.
 
if employer requests a hearing, which they have a right to do, go to the hearing and take along a record of your phone calls and what was said and by whom it was said. Sure sounds like harassment to me and unemployment is continuing your benefits so they believed your original story.
