my husband is in jail for 4 months now and the district attorney doesnt have any evidence. the charges are lewd of act on a child under 14 an d kiddnapping my a child under 14. but he is innocent. my sister told the public defender that she lied. so now they are going to pretrial and i just need some advice on what to do. i dont really know any thing about the law so somebody help me. what is pretrial? and can the DA make a new whole case if they wanted to.somebody help. what is th defender suppose to do to ensure he is not going to prision. he is falsely accused and i do not want him to go to prision and years later come out and saying hes innocent. what can i do to ensure that is not going to happen to him. because there are alot of men that go to jail for years for nothing. thats just years away from your life, family, friends, everything. i do not want that to happen so please somebody that can give me some advice speak out and reach to me and let me know what to do. god bless and thank you
ok the 14 yr old is my sister. and i know we have to protect our children but what about husbands, dads, granddads that are being falsely accused by these children. children lie for attention, angryness, make believe stuff, any thing, its not like they intentially do it but when stuff gets to far they have to stick with what they say because they dont want to get in trouble. so you are trying to say that we should protect our children but not the dads and husbands that are really innocent and are put in jail for no reason missing years and years of their life. and yes our justice system is so great that thousands of people get falsely accused and go to prision everyday. and years later they say oh hes innocent well that doesnt give the years back that he lost does it. i need help. not criticism.

He needs to address his issues to his public defender and allow the criminal justice system do it's job...sexual offenses with minor children is a very serious crime..with serious consequences..we must protect our children at all times..

Even if convicted he probably won't do jail time for the lewd act, but still be a registered sex offender. The kidnapping charge is another thing. If the statement by your sister is registered as evidence or is put on the stand during a trial then he should get off. A pretrial is where he goes before the judge to either enter a "guilty" or "not guilty" plea and start picking jurrors for the jury, and where lawyers make motions for dismissal and some other stuff.
