Depends on the judge's sentence. They don't offer a plea of county jail or probation. You plead guilty or not guilty. I'm assuming that he will plead guilty in exchange for a sentence of probation (no jail time). If they're going to throw him in jail anyway, take your chances in your court. It would be stupid to plead out.
