My Call of Duty 4 CD got scratched when my Xbox 360 fell?

SO it fell and the whole disk got messed up and i bought it from Blockbuster . I wanna return it but i went there 3 times and they said it it scratched and we cant refund our money. They wouldn't exchange it either. So i don't know what to do right now and i don't want to pay another $60 to get a new one. So any ideas? I've been thinking of renting CoD4 from there and switching the Cd's but i don't think that's fair. Oh and will Activision send me a brand new one if i send them my old one and a proof of purchase?
 
I say the activision is your best bet. Usually these companies offer those kind of services if you can prove that you purchased it. Maybe check their website and see if they have instructions on how to go about this.

2 wtf would u buy a game from block buster

3 why would u buy a ps3 its a huge waste of money for gaming only real use is blue ray..
