...pay it, will i be taken to jail? He was driving the car and took the keys. I was nowhere near the car during the incident. What can i do? I do not have the money to pay for it. Nothing at all.
I did not lend the car to him, rather it was taken without my permission. "it" refers to the DUI violation. I was reading the Illinois State Law regarding DUI, it simply stated even if the car was under someone's name, the person is responsible for the DUI.
 
"If I do not have the $ to pay it . . . " "It" being your bother's bond? Your bother's court costs? Your brother's fines? Your brother's attorney's fees? The impound fee? In any case, you won't be taken to jail if you weren't driving. After all, DUI stands for DRIVING under the influence.
 
Your question is not very clear--what is the "it" you do not have "the $" to pay? I am assuming your car was impounded, and you are complaining that you don't have the money to pay the impound fees.

Most states have a host statute that will not cut you any slack--the law assumes you gave your brother the keys. You won't be taken to jail, but you won't get your car out of impound either.

It will cost more to get it out later.

Next time, be a little more selective when lending your car out to drinkers.
