My 10yr old son was kicked out of his 2nd grade class for smoking in the

teachers lounge can I sue the school? They don't have a smoke room for the students and they violated his rights.

Absolutely you should sue not only for infringement of his rights but for the public embarrassment and ridicule he is suffering and I would use the answers provided here as evidence. Who do those people think they are?
