I've had my pay garnished due to a bill that my ex husband was ordered to pay in our divorce. I recieved a release of the garnishment, and called the attorney that was handling the case. They said the balance was paid in full. (paid partially by me via garnishment, partially from someone else.)
Here's where it gets tricky. I get paid bi-weekly, and my employer had been sending in payments at the end of every month. The last payment they sent was Nov. 1, of money they held from my 2 October checks. Now it's December 15, and they've held 3 more payments (2 for Nov, 1 for Dec). My employer has custody of that money. Will they have to send that to the court, and I'd get refunded from the courts, or canthey refund that money to me? The date on the release is Dec 10.
I want to make sure that the overpaid money is returned to me, and not to my ex, as it came out of my paycheck.
