Modern warfare 2 and my flashed xbox?

Actually microsoft doesn't scan for the copied game, they scan for the flashed drive. This means that it doesn't matter what game you are playing or what you are doing as long as you have that flashed drive and you are on xbox live there is a chance of getting banned. Im sure there are ways around this just look around on google
 
Can i Play A purchased copy of modern warfare 2 on xbox live on my flashed xbox? will i get banned? I have an active account, i know my xbox doesn't have the wave 4 patch, I want to know because I heard xbox can only detect software mods by seeing if your console is running a back up game. I want to know because my aunt is buying modernwarfare2 for me. please help, all serious answers are appreciate.

BTW my xbhox has not been hooked up to live since it hs been modded
