Son-in-law charged with 3rd felony over the week-end after he beat up my daughter. Has 2 previous felony convictions in VA. Does 3 strikes rule apply for this felony in MO? We're hoping this piece of scum will be put away for a long time so our daughter can get on with her life.

I really can't say about Mo, but I think you may get your wish. My nephew did a year in Ca for battery on his wife, 2nd offense.

I am unsure, but if your daughter feels the same way she can ask to speak to the DA to push prosecution of this individual. The DA would push for the harshest punishment if the DA has a Vitim that is willing to put in 100% on the prosecutions side.

Also add a human component to the case, not just the police report and evidence. They (DA) has actualy met the victom.

If I had to guess I would say the 3 strike law would apply, You would want the DA to know he has 2 previous felonies so he doesn't sneak thru the cracks in case they dont run his criminal record. It has happend.

They do a pre-sentencing investigation long before they go to trial.
They absolutely do take other convictions into consideration which have not been overturned.
That is why it takes so long for Missouri courts to try anything, but they are better prepared for their cases than most states and tend to be very tough with repeat offenders.
Don't worry, he could end up serving at least 5-10 years of actual time and if the felonies are all violent in nature, he may have to serve 30 before being eligible for parole there.
