My husband pays child support but has recently been laid off due to lack of work. He has been looking constantly for more work and so far no luck. He was just denied unemployment because of lack of time quarterly. Now because of all of this he has fallen behind and is about 1100 in the hole. I have been helping him here and there trying not to get too much more behind. I do not make enough to pay it and we have rent and two kids of our own. He went to the friend of the court and they said at the time their case was not listed with them so they could not modify anything. They said they would have to go back to court to get it remodified ,and he couldn't afford an attourny due to lack of work.
Orighionally they went to court back in 2002 and she never showed up to court or to the FOC date. So they just ordered him to pay her personally 107.00/wk and the FOC case was thrown out. Now she brought a paper for him to sign to re-open their FOC case (which he did). But I am worried because he is currently a bit behind because they couldn't modify it when he tried . He thinks because of all of this they may look back and see that he had no income and what he had owed may be lower. I was not sure so I wanted some input and just incase I wanted to see how far behind you have to be before they send you to jail, suspend your liscense, or garnish taxes..ect..ect. I would rather be educated completely on the situation.
