Mechanics' Lein after closing?

OK, so we have been having problems since buying our house in June of 08. We first looked at the home and loved it, it's only 2 years old and never lived in. When we decided to purchase, the selling agent told us he was going to replace the carpets and paint the interior. NOt sure why he replaced the carpet, it was in great shape. But, anyways, he replaced the carpet with some cheap stuff and did an awful job not it's lifting. And the paint was a totally different story. It's everywhere. In the bath, shower, on the mirrors, baseboards, cabinets, etc. So we were pissed and told them to fix it, so they hired another painter to come in and fix it... but it looked the same, so we said oh forget it, and closed the deal...

NOw there is a mechanics' lein against the home from the selling agent not paying the sub-contractors for the work done...

We are going to go to court over this... What should I seek in damages and do you think this will hold up in court?
