Legal Hold past end of active service for court martial? GI bill?

I have served 4 years and 10 months of my 5 year contract with the marines honorably. Now they want to place me on "legal hold" because of some trumped up charges which my lawyer told me shouldn't even go to a special court martial. But my command hates me and wants to take it to the limit. According to my military lawyer they haven't even officaly charged me yet but they will not let me go on terminal leave and say they are going to charge me to a special court martial. How long can they just keep saying this and keep me on legal hold?

And can I get my gi bill if I get a general under honorable or an OTH discharge? Given I have served for 4 year 10 months already and payed into it?
 
If you are convicted of those "trumped up" charges (I doubt they are, take some responsibility for your actions) then you do risk losing the GI Bill benefits. So if you can try to plead down to an NJP for a lessor offense or a summary court martial. That will depend on the command as well. though. And when you get out and get into trouble on the civilian side don;t blame someone else, blame yourself.
