If you are a service company (example: towing company) is there general legal liability to keep your customers safe?
Here's the scenario: I'm a towing company and you break down. You (or a police officer at your wreck scene-which is COMPLETELY legal and if a police officer calls a tow truck for you, you have to pay. That is legal-anyway) calls for me to tow your car. I load your car up and let you stay in your vehicle as I tow it down the road.
Is there any legal liability on my part to not do that? Even if you request it.
Many states have laws against it, but I have to find something LEGAL IN WRITING (not just opinion) to prove my point that it is NOT safe.
I don't think it's safe because I feel that if anything happens (such as the tow truck getting in an accident) it could cause the customer MORE harm and I feel it would fall under complete negligence from the company.
Anyone have anything in writing, even if it is a general law for businesses to keep customers safe? I have looked and cannot find anything specific if it is legal or not to tow vehicles while passengers are in the car.
