I do not understand how someone could be so heartless towards a child. They are sinless. They have not lived long enough to become jaded and corrupt like those of adult ages. This wasn't some fucking criminal on death row. This was a child. I'm glad to here she was okay. But for those that laughed an ass whooping was in order.
 
If I'd see 5 people already calling 911 in that situation I'd probably just go on doing whatever I was doing, because I can't help anymore. If it was just me there then of course I'd call 911 and see if I could help (probably I wouldn't be able to) and then help the ambulance to get to the place, but that'd be all. In you situation it wouldn't matter wether 911 got 1 call or a 100 calls.. the speed with which they'd come would probably be the same...

in this particular situation, a lawsuit could be brought about. but lets say that you walk down a road that drops off a cliff and you hear a cry for help. you look down and notice that theres a person just below you, who you could easily pull up. but you walk away. the good samaritan law applies to that. simply put, depends on the situation

This is correct. Unless you're a trained EMT/ER Surgeon the best thing to do is to call for help and do your best to make sure the victim is aware that help is on its way. Moving the car without necessary equipment and medical help could prove fatal to the vicitm as well as putting you in harms way. The only time you move a seriously injured person is when their life is in imediate danger. e.g. the car is on fire.

Good samaritan laws, depending on the states, can have two parts. Part 1 protects you from lawsuits for helping IF you're qualified to offer the assistance you offered. CPR if you've got the certificate for example. If you're not qualified you're fair game. The second part of a good samaritan law provides that you can be sued for not offering help you're qualified and able to give. This mostly applies to Emergency workers and hospital staff.

As for the person hanging on a cliff, no a good samaritan law would not cover that. That would be called negligent hommicide.

However in any other situation, like a car goes into a canal, you can jump in and try to save the person. Or in a burning car, you can try to save someone.

No, Good Samaritan laws have NEVER been meant to be used in that way. That is from a TV show, NOT reality, I don't know why that's so hard to understand. I even posted a list of what each state covers in their laws, did you even bother to read it? None of them mention anything about your make-believe stipulations of the "law."

In the situation you described, there could be no criminal charges filed, regardless of Samaritan law, because it doesn't apply to cases like that. However, a family member could possibly file a civil suit.
 
It's a very common phenomenon. In psychological terms, I think it's called Diffusion of Responsibility. There was a very famous case a couple years baeck in BC; a woman was beaten and murdered while walking to a friends one night. Apparently she screamed for like 10 minutes, and a whole bunch of people who were in their homes heard it and not a single one called the police.

Quite simply, the more people there are around to witness a crime or a distressed cry, the LESS likely one of those people will call for help! This is why you should ALWAYS call police or an ambulance, even if you see other people talking on cell phones. For all you know, they could be telling their friends and family about the corpse on the sidewalk.
 
omg..the world is sick..and I would of beaten those ppl..who can laugh and make jokes? Ok ok Ive laughed when the pain in something been so hard..that i'd try to cover it up with laughter..but making jokes? and spitting..and not calling the police? I feel sick..

Ive heard in a tv program that you should shout "fire fire!" instead of "help help" because..more will come when you shout fire..and that is sad

maybe just shout the situation. "there's a fucking girl under the car!"
 
It's illegal to shout fire in a crowded movie theater unless there really is a fire. This stems from an actual case in which the US Supreme Court ruled that such an act is not protected speech. (In the case someone yelled fire, the crowd rushed the door and people were hurt/killed and the defendant tried to say it was his right under the first ammendment.)

However, yelling FIRE in an actual emergency is not likely to get you into trouble. The police aren't likely to have you prosecuted for yelling "FIRE" when you were being mugged. If the situation warrants a cry for help, any cry designed to gather attention will work. Besides, the media attention alone would cause most police departments to let you slide on that one.

Man, that's fucked up what those girls did. If I was there, I would have tried to do something, other than sit there talkin on my cellphone.
