Lawyers, law students, please help in handgun charge?

Hello all, I was driving and pulled over by undercover cops because my tags were in the window and not affixed to the car. Actually, they didnt pull me over because I was parking in front of my house. My friend was in the passenger seat. We got out the car ( in front my house) and one house came to me for licence and registration and the other officer AUTAMATICALLY started searching my friend. They found a handgun on him. Now, I dont belive there was any reasonable suspion or probable cause for searching him. Ive been pulled over numerious times and me nor the passengers have been searched. What should I do? What do you think will happen in court? ANY ADVICE is appreciated, thank you.
 
Was your friend charged? If so, he has the right to a lawyer, and I'm sure once that lawyer knows the search was questionable, he or she can take it from there. It certainly seems like an unreasonable search ... there was no reason for anyone to be searched, let alone the passenger. But obviously the police might see it differently.
 
The police do not need probable cause or reasonable suspicion to do a pat down search of someone they have detained. Your friend is facing some big problems and how the search happened will not help him. A real lawyer will.
 
In recent years, the courts (including the US Supreme Court) have been more permissive regarding searches of persons in vehicles, including passengers and including vehicles not involved in traffic offenses.

Was your friend charged? Sounds like it. Your friend needs to get an attorney ASAP.
