It has been almost 2 years, from the time we made application for a deed in lieu. We thought it was the responsible thing to do, after draining all of our resources and had nothing left and were unable to pay.
It took 6 months to get approved for the deed in lieu and the documents that were drafted by PHH Mortgage's attorney were signed Feb. 28th and have been sitting on someone's desk at PHH for over 4 months.
My useless lawyer says "they have not decided if they are going to accept the deed in lieu.".
PHH Mortgage approved us.
Their lawyer sent us documents to sign.(Wasn't this an offer?.)
We signed them and returned them.
(Wasn't this an acceptance of an offer?)
THEY HAVE BEEN SITTING ON A SIGNED AND NOTORIZED DEED FOR OVER FOUR MONTHS
(Note: this is a FNMA held mortgage, which PHH has tied up with their non-sense for almost a TWO YEARS, which mean FNMA will suffer greater loses than they should have and as you know this all falls back on the taxpayers)
Note: Please no wise cracks. I did everything thing I could to try to avoid this situation. It was a last resort solution so that the lender did not have to do a costly foreclosure = I should have let them foreclose)
Any lawyers out there with any suggestions on what to do?
I wrote PHH. (who has not contacted me in over a year)
I wrote FNMA.
I wrote my congressman.
