Laws and rights in Australia about graffiti?

I'm concerned about my cousin, he's been doing alot of graffiti lately.
and he got caught for painting "tagging" a wall, and private property.
what are his rights and what is the best thing to do.
 
Well he could stop damaging other people's property. He will end up in court and recently cases have seen jail time if it's severe enough.

In addition a property owner can sue for the clean-up bill.

Tagging is really the lowest form of graffiti unlike the beautiful murals you can see - it's like a dog pissing on a tree then another one coming along and pissing over it. It's pathetic.

He has the same rights as all accused criminals - that's what he is.
