...Should I sue my mechanic? I'm probably going to look like the hugest loser in the world for posting this but...I've been waiting over THREE(not 1, not 2, but 3.5) years for my car to get fixed. Originally my friend looked over the car, then gave it to his friend/former boss to assist with working on it. In early 2005 I prepaid $1700 for the work to be done, saw the car doing nothing but SITTING in the mechanic's lot, so I asked for my money back to put it towards more pressing bills since nothing was being done with my car and the mechanic claimed he was "sooo swamped with other work". A year later(2006) the mechanic claimed he was freed up, so I repaid $1700 for the work -- $700 for the parts, and $1000 for labor. $1000 is actually MORE than estimated cost of labor, but I wanted to make sure I had everything covered so the mechanic couldn't turn on me and claim "But we ran into this problem with the car, now we need more money".
Still nothing but empty promises. The car still sits. Should I sue him?
And before you all blast me, yes I realize I was way too nice and a pushover. I was too nice to prepay ahead of time, be so goddam patient, and not take him to court earlier. I used to be a total pushover and although I've gotten better in recent years, unfortunately I still have to sift thru some of the problems from a few yrs ago that occured as a result of me being a stupid pushover. I'm not naive/oblivious, I know when I'm getting screwed over, I'm just too shy to do anything about it for fear of looking "not nice".
I'm thinking of filing a small claims lawsuit and taking him to court. I have a handwritten receipt verifying the money I'd paid him for the repair. I know a bit about small claims court because I'd already sued a different a-hole 3yrs ago for an unrelated issue(an a-hole that stole money from me and didn't hold up his financial responsibility in a joint contract). Should I sue? I've given this guy many chances. Should I warn him first I'm gonna sue, or just do it?
Here's insult to injury. Last year, the same friend who'd given the car to his former boss, was talking to me on the phone. He nonchalantly announced, "The VW's running again". I said "my car's fixed?!" and he said, "No, I'm talking about Ivan's VW." I expressed subtle unhappiness at my car still not being fixed, so my friend said, "But Ivan's been waiting such a long time!! He's been waiting a whole year!" even though at that point, I'd already been waiting over TWO years! I can't believe how little they're respecting me! I wish I had a p*nis, maybe then they wouldn't push me around so much.
Visvardi, F*CK YOU I **do** have the money I paid him in writing. And the reason I prepaid was because they told me that they didn't have the money to put out for parts and that I'd have to pay them first. And yes I do prepay for many things, (because I'm too much of a loser pushover--whoops, I mean 'nice') for example I prepaid for items I ordered from the Delia's clothing catalog a few yrs ago and they did the same thing...kept my money, never sent me the stuff I ordered, then I called them up and inquired about it just to find out that the stuff had been sold out so they simply never bothered to send my money back until I inquired about it. I'm obsessed with paying things ahead of time so people cant accuse me of owing money, having bad credit, etc but obviously it's a "sin" for me to be such a reliable debtor so I don't think I'll be doing that ever again f**k it.
Yeah and Sandi, on top of that, it's an antique old car that's already prone to rusting and the whole bit. It's also a car with TONS of sentimental value and because it's an antique, it's not easily replaced unless I pay an arm and a leg and travel across country to find one.
