Is there an Android phone that browses in a hotpsot but which AT&T does not

consider "Smart"? I've discovered that, without a data plan on my phone, AT&T prevents my phone from browsing even in a hotspot. But with a data plan, AT&T would let me browse all day in a hotspot without charging against my data allotment. Is there an Android phone in existence which can browse in hotspots but for which AT&T does not insist I buy a data plan?
