Is there a way to fight being chaptered out of the army?

I asked this question once and got some pretty mean answers. Lets start by saying that he is not a POS and he is not a "sh*t bag" like some answers said. He is excellent at his job and has received numerous awards for it. The first SGT has even come to me and told me that he is the best bradley mechanic that they have. He has an unusual personality and not many people understand him. Hes pretty quiet and he just goes with the flow. He wont really object to much, although he will ask questions so that he can do his job as best as he can. That annoys his SGTs to no end. Anyway, he received an article 15 just after he got home from Iraq for councelling statements. he had 7 two or three were for being late in Iraq because of his sleeping disorder. The rest were very minor things that were dismissed by the SCO. Since then, he has not been late, hes been going to a counselor, and hes not had a single council. They are charging him with another art 15, for what we don't know. They are also threatening chaptering him. Hes really trying to get everything together and be the best soldier he can be, we just need help fighting this chapter thing.
he has had 7 councelling statements in the 4 years he has been in. In addition, this troop gives out article 15s pretty easy. Im not defending him, really. If he is a POS soldier than he needs to get out. However, he has done everything they ask of him and more.
 
you are probably gonna hate me after reading this but here goes:

He has had 7 negative counseling statements and 2 article 15's? What is his problem. I have known some pretty big sh*t bags in my time in the army who havent ever gotten art 15's. I would say that his chances of claiming PTSD from his deployment to Iraq are non-existent since he's a POG (people other than grunt) so he has no excuse on why he can't adapt to the standards that are set for him. There are millions of other people who have served with no problem. Sometimes certain people aren't cut out for the military and have to be chaptered out for the greater good of the rest of us. Being late to work or formations can be considered missing movement and that's a serious enough offense in itself. I think he just needs to not fight it and get kicked out quietly like he should be. I can tell you that I would not want somebody like this in my unit and I can say for sure that I would not want this individual as one of my soldiers.
 
The Army must be really brutal if you can be chaptered out after 4 years in?? No wonder people flock to the Air Force and Navy.

It looks like a sweet deal at face value but not after they lock you in.
 
Ok.

To start with - all you have is one side of the story. Chaptering a soldier is an administrative nightmare that is not used if the command sees the soldier as 'salvagable.'

So far he has seven negative counseling statements. (This is a lot.) In addition he has two Article 15's. These add up to: 'Problem soldier' in the eyes of his senior leadership.

Before the decision to chapter a soldier is made the commander will discuss the issue with all of that soldier's NCOs and give great weight to their recomendations.

In addition the chapter process requires legal review by JAG. So there is plenty of time for the soldier to 'fix himself.' The thing to remember is that _he_ is the person with the bad reputation and only _he_ can correct this. And - sad to say - once he has gotten himself to this point he is going to have to perform twice as well in order to be regarded as half as good.

About the only thing I can recommend is that he request a 'rehabatilitive transfer.' This will place him into a new unit where his history will not be known and he will have less of a reputation to live down.

BTW - if he does manage to avoid being chaptered I suggest that he volunteer for an overseas assignement. This will get him into a new unit where he will have the chance to start over with a clean slate.

Im not sure what the entire situation is, but I am sure by now you must have contacted Jag. If not then that would be my first course of action.My second choice would be to go to a chaplain they are a wealth of knowledge. Gather as many statements from those around him team members and naturally the higher up the chain of command you can get references from the better.
