I borrowed $5000 from a friend approx 4 yrs ago & in an IOU wrote that "when I get a job & have extra money after paying my bills I will start paying $100/month". I got a job but don't have extra $ after paying bills. In fact, I'm struggling from paycheck to paycheck & am behind on my mortgage pmts. I had tried to contact this "friend" approx 2 yrs ago, just to keep in touch & was unable to get ahold of him; phone # disconnected...He finally contacted me about a yr ago & shortly thereafter asked when I was going to start sending hime $100/month. I explained my financial hardship & got no sympathy. He is "coming in hard" & threatening small claims court.
That answer makes no sense. If he's got 3 yrs (from when?) & it's been about 4 yrs since IOU then what do you mean when you say he'll sue you well before any SOL runs out?
