Is the top light on a jeep cherokee supposed to work?

Is the 3rd brake light (the one on the top of the back hatch) of a 99 cherokee supposed to work or is it just a reflector. how do you change it if it is a light. i unscrewed it and it wouldnt move. will this fail me from the drivers licence check
 
The lens is stuck. Pry it off gently.
It should not fail you as long as you have the other 2 tail lights
