yes, because people will assume that they have a "right" (as in bill of rights) to free healthcare...and in essence, they will.
once it is signed into law the lawsuits as to what is and is not Constitutional will begin.
Just like the Miranda rights, which if not given correctly are now "a violation of the 4th ammendment" even though the Constitution never mentions anything about the government needing to read rights to people before they are arrested and questioned.
